The appellate court's decision in
Salazar v. Diversified Paratransit, Inc. which was heavily criticized, will now be considered by the California Supreme Court. You can read about the background of the case as well as the decision to take the case up
here. The issue turns on the responsibility of an employer for the actions of customers who are sexually harassing an employee. It is quite likely the Supreme Court will place more burdens on the employer than the appellate court did. For a professor's critique of the decision and my, perhaps prescient view, check the earlier
note.
