A couple of days ago I mentioned the trial of a bank employee suing because her home phone call had been monitored, she had been reprimanded and ultimately forced to leave her job. Since the report was based on opening statements, I suggested it had all the agreements of a potentially bad case depending on the credibility of the witnesses. Here is that
note. Now the jury has spoken,
Jury: Couple OK to listen to phone call and what could have been a disaster for the employer, is instead a triumph. Bad (alleged) facts aren't always believed. It's the uncertainty of knowing when they will and when they won't, that makes the decision to take a case to trial so challenging.
