The First Court of Appeals gives a good overview of the law on an employee's obligations when preparing to compete with his employer. In
Abetter Trucking Company v. Arizpe (Ct. App. - Houston [1st] 7/3/03) it upholds a jury verdict that the employee did not breach his fiduciary duty to his employer, even though he resigned and a dozen of the company's drivers went to work for him at his new company the next day.
